Quarantine
(1) Establishing Quarantine. A quarantine is established against the following:
(a) Virus diseases of grape, known as fanleaf (grapevine fanleaf virus) and leafroll (grapevine leafroll virus);
(b) Grape Phylloxera, Phylloxera Vitifoliae.
(2) Area Under Quarantine. All states, districts, and territories of the United States except Oregon.
(3) Commodities Covered. Plants and all parts thereof (except fruits) of grape (Vitis species).
(4) Restrictions:
(a) Commodities Prohibited from Quarantine Areas: All commodities as described in section (3) of this rule, including all plants
and cuttings and rootings of such plants originating or grown within or shipped from the area under quarantine as set forth in
section (2) of this rule, except as provided in subsection (b) of this section, are prohibited entry into the State of Oregon
whether moved directly from said areas or diverted or reconsigned from any such areas;
(b) Commodities Admitted Under Origin Certificate: Only grape cuttings and rooted plants in pots of soil-less sterile media from
the quarantined areas set forth in section (2) of this rule which have been certified in accordance with the regulations of an
official state agency, which certification program includes inspection and testing by indexing on suitable indicator hosts for fanleaf
and leafroll virus diseases may be permitted entry into Oregon; provided, that all shipments of such grape cuttings or rooted
plants shall be accompanied by a certificate issued by said official state agency of the state of origin certifying that said grape
cuttings or rooted plants were produced under official certification regulations and meet official certification standards as to
freedom from fanleaf and leafroll virus diseases, and that any of said rooted plants were grown in soil-less sterile media and are
free of said virus diseases and grape phylloxera;
(c) Grape Cuttings Imported into Oregon to be Held: All grape cuttings or rooted plants imported, shipped, or moved into
Oregon subject to the prohibitions set forth in subsection (4)(a) of this rule shall be held in his possession by the person who
ordered and receives such grape cuttings or rooted plants, who shall immediately notify the Department at the time the grape
cuttings or rooted plants are received of such fact. The person shipping or moving such cuttings or rooted plants into Oregon
shall immediately notify the Department of the time of the shipment of such fact. Such cuttings or rooted plants shall be held in
the original shipping container in the receivers possession, as required by this paragraph, until they have been inspected and
released by an inspector or representative of the Department.
(5) Disposition of Commodities in Violation of Quarantines. All commodities as described in section (3) of this rule inspected by
the Department and determined to be in violation of this quarantine and not permitted entry pursuant to subsection (4)(b) of this
rule, shall be immediately returned by the person receiving same to the point of origin or, at his option and without expense or
indemnity paid by the Department,destroyed by such person.
(6) Exception:
(a) The Department may issue special permits allowing movement of restricted commodities into this state for research
purposes, which commodities are not otherwise eligible for movements under the provisions of this quarantine. Such movement
into this state shall be subject to any conditions or restrictions set forth in said permit. A written application for such permit shall
be made to the Department, and the permit issued, prior to any movement of such commodities into this state;
(b) Exempt from the certification requirements as to virus freedom of this quarantine are cuttings of American bunchgrape, Vitis
labrusca.
